Terms and Conditions
- The construction of the works by the company shall be in accordance with those specified in the quotation/estimate.
- The customer shall, during the period of the contract, allow access to the company, its vehicles, staff, and machinery onto the property for the purpose of construction, without any obligation on the company to make good any damage to cattle grids, entrance roads, drains, water pipes, or cables.
- The customer warrants that there are no pipes, wires, cables, drains, or any other obstructions whatsoever on the ground where the works are to be constructed, and confirms that all necessary planning consents have been obtained. The company cannot be held responsible for damage to underground services. Delays caused by such circumstances may be charged at the company’s hourly rate as specified in the contract agreement. Costs for covering overhead cables to avoid electric arcing will be passed to the customer. No liability is accepted for overhead wires damaged that are sagging below statutory height.
- The company will not be responsible for the disposal of waste materials derived from the site during construction.
- The works must not be used by the customer prior to final completion. After completion, any surface must be regularly maintained, especially during the running-in period, as outlined in the maintenance instructions. Failure to maintain an even surface depth may damage the membrane or base and could invalidate relevant guarantees.
- The company accepts no liability for defects or subsidence arising from weak or unsuitable foundations. The customer must ensure the foundations are adequate. Additional costs will apply if ground strengthening is required.
- The company will not be liable for defects in finished concrete surfaces, such as colour inconsistencies or hairline cracks.
- All quotations assume a sub-base of earth, clay, or similar materials. If rock, concrete, tarmac, or other solid materials are encountered, removal or work-around costs are the customer’s responsibility.
- The contract price excludes VAT or any additional taxes or levies that may be imposed.
- Ownership of Goods
a. Property and title of goods do not pass to the customer until full payment has been made. If, before payment:- The customer, being an individual, becomes bankrupt or arranges with creditors, or execution is levied on their assets.
- A receiver is appointed in relation to the customer’s affairs.
- A meeting of creditors under section 293 of the Companies Act 1948 is convened.
The company may enter the customer’s premises to recover goods and complete an inventory.
b. “Payment Terms” refers to the date funds are received by the company, either by electronic transfer or in cash.
c. The customer shall indemnify the company against loss or damage to goods prior to the transfer of ownership.
d. If the contract is cancelled, all title and property of goods shall revert to the company. - The company’s liability for breach or non-performance is limited to the value of the goods concerned.
- In cases of repair or rework, the company will carry out the work at its own expense if due to its own materials, workmanship, or failure under the contract.
- This contract includes all agreed terms. No previous statements or representations (oral or written) shall be considered part of the contract.
- Any works not specified in the quotation will be charged as defined in the contract agreement. All such works must be authorised by the proprietor.
a. Customers hiring MSA labour and machines on a daily/hourly rate must liaise directly with operators for instructions and material orders. - Any interruption to the contract caused directly by the customer will be charged at the specified hourly rate.
- The company is not responsible for damage caused by delivery lorries or delays in delivery. It is the customer’s responsibility to ensure access is hard, high, and wide enough for delivery vehicles.
- It is at the delivery driver’s discretion whether access is suitable for entry.
- Any additional surface top-ups must be paid for in advance at the current rate.
- The customer is responsible for ensuring the products ordered meet their satisfaction.
- Sand surfaces must be sufficiently watered by the customer before first use—equivalent to at least 1.5 inches of rain. Other surfaces have specific maintenance instructions provided.
- The company is not liable for variations in colour or performance of silica sand, though high quality will be maintained wherever possible.
- All quoted material depths are approximate.
- Drainage and base material colour or size may vary based on local conditions. If the sub-base is weak, larger stones or hardcore may be required at the company’s discretion.
